전 문Preamble
우리는 인간이 태어날 때부터 자유롭고 존엄하다는 보편적 진리를 다시 선언한다. 그 어떤 국가, 이념, 권력도 인간의 존엄 위에 존재할 수 없으며, 공포와 강압, 거짓과 고립은 결코 정당한 통치의 근거가 될 수 없다.
오랜 세월 동안 한반도의 북쪽 땅은 폐쇄와 억압, 개인숭배와 폭력의 체제 아래 놓여 있었으며, 그로 인해 수많은 생명이 자유를 박탈당하고 세계로부터 단절되었다. 우리는 이 비극의 역사를 반복하지 않기 위해, 그리고 침묵 속에 고통받아 온 사람들의 권리를 회복하기 위해 새로운 출발을 선언한다.
이 헌법은 과거와의 단절을 선언하는 윤리적·정치적 약속이자 의지이다. 우리는 공포가 아닌 법으로, 충성이 아닌 책임으로, 폐쇄가 아닌 개방으로 국가를 재구성하고자 한다.
우리가 지향하는 새로운 국가는 단일한 민족, 혈통, 문화, 역사 신화를 중심으로 정의되지 않는다. 새로운 국가는 인류 보편의 가치 위에 서는 글로벌 시민 국가이다. 우리는 민족과 문화, 역사를 부정하지 않으나, 그것을 절대화하거나 배타적 정체성의 근거로 삼지 않는다. 과거는 기억하되 숭배하지 않으며, 전통은 존중하되 미래를 속박하게 두지 않는다.
새로운 국가는 고정된 이념의 산물이 아니라, 끊임없이 스스로를 성찰하고 개혁하는 열린 공동체이다. 그 정체성은 혈통이 아니라 시민적 가치에서 나오며, 권위가 아니라 합의에서 형성된다.
우리는 이 국가가 세계와 단절된 고립된 공간이 아니라, 국제사회와 책임을 나누는 일원으로 존재하기를 선언한다. 국제법, 인권 규범, 평화 질서를 존중하며, 인류 공동의 문제 해결에 참여하는 성숙한 행위자가 될 것을 다짐한다.
이에 우리는 국제사회와의 연대 속에서, 그리고 자유를 향한 우리의 숭고한 투쟁의 역사 위에서, 북한과도임시정부를 수립한다. 이 정부는 영구 권력이 아닌 전환의 도구이며, 지배가 아닌 봉사를 사명으로 삼는다. 그 존재 이유는 단 하나, 억압 이후의 사회를 정의롭고 자유로운 질서로 이행시키는 데 있다.
이 헌법은 한 민족만을 위한 선언이 아니라, 자유를 갈망하는 모든 인간과 함께 쓰는 약속이며, 닫힌 체제 이후에 올 세계를 향한 공적 선언이다. 이로써 우리는 인간 존엄, 자유, 평화, 책임, 그리고 개방이라는 보편적 가치 위에 새로운 국가의 첫 문을 연다.
We reaffirm the universal truth that human beings are born free and dignified. No state, ideology, or power can exist above human dignity, and terror, coercion, lies, and isolation can never be grounds for legitimate rule.
For a long time, the northern land of the Korean Peninsula has been under a system of closure, oppression, personality cults, and violence, resulting in countless lives being deprived of freedom and severed from the world. We declare a new beginning to prevent the repetition of this tragic history and to restore the rights of those who have suffered in silence.
This Constitution is an ethical and political promise and will to declare a severance from the past. We seek to reconstruct the nation not with fear but with law, not with loyalty but with responsibility, and not with closure but with openness.
The new nation we aim for is not defined by a single ethnicity, bloodline, culture, or historical myth. The new nation is a Global Citizen State standing upon universal human values. We do not deny ethnicity, culture, or history, but we do not absolutize them or use them as grounds for an exclusive identity. We remember the past but do not worship it; we respect tradition but do not let it bind the future.
The new nation is not a product of fixed ideology but an open community that constantly reflects upon and reforms itself. Its identity stems not from bloodline but from civic values, and is formed not by authority but by consensus.
We declare that this nation exists not as an isolated space severed from the world, but as a member sharing responsibilities with the international community. We pledge to become a mature actor that respects international law, human rights norms, and the peace order, participating in the resolution of common human problems.
Hereby, in solidarity with the international community and upon the history of our noble struggle for freedom, we establish the Provisional Government of North Korea. This government is not a permanent power but an instrument of transition, and its mission is service, not domination. Its sole reason for existence lies in transitioning the society after oppression into a just and free order.
This Constitution is not a declaration for one ethnic group alone, but a promise written together with all humans yearning for freedom, and a public declaration toward the world that will come after the closed system. With this, we open the first door of a new nation upon the universal values of human dignity, freedom, peace, responsibility, and openness.
제1장 총강: 북한과도임시정부 수립의 정당성과 국가의 본질
Chapter 1: General Provisions
제1조 (북한과도임시정부 수립의 필연성과 정당성)Article 1 (Inevitability and Legitimacy)
① (보호책임의 방기와 주권의 박탈) 국가는 국민의 생명과 자유를 보호할 때만 주권을 행사할 정당성을 가진다. 그러나 현존하는 북한의 국가 시스템은 자국민을 보호하기는커녕 국가 권력을 동원하여 조직적으로 생명을 박탈하고 자유를 억압하는 가해자가 되었다. 이에 국제법상 '보호책임(Responsibility to Protect, R2P)' 원칙에 따라 기존 정권의 주권은 효력을 상실하였으며, 주민을 보호할 새로운 주체로서 북한과도임시정부의 수립은 선택이 아닌 법적·도덕적 필연이다.
② (저항권과 자위권의 발동) 현 정권은 상식과 이성을 거부하고 폭력으로 통치하는 범죄 집단으로 전락하였다. 이에 북한 주민과 임시정부는 압제로부터 생존하기 위해 천부적인 자위권(Self-Defense)과 저항권을 발동하며, 이는 국제 인권 선언과 문명사회의 규범에 부합하는 합법적인 권리 행사이다.
③ (상식적 정부의 복원) 본 정부는 비이성적이고 야만적인 독재 시스템을 해체하고, 합리적이고 합법적이며 이성적이고 상식적인 헌정 질서를 수립하기 위해 존재한다.
① (Abandonment of Responsibility to Protect and Deprivation of Sovereignty) A state possesses the legitimacy to exercise sovereignty only when it protects the lives and freedom of its people. However, the existing state system of North Korea has become a perpetrator that systematically deprives lives and suppresses freedom... (R2P) principles apply.
② (Exercise of Right of Resistance and Self-Defense) The current regime has degenerated into a criminal group... North Korean residents invoke the natural rights of Self-Defense and Resistance.
③ (Restoration of Common Sense Government) This Government exists to dismantle the irrational dictatorship system and establish a rational constitutional order.
제2조 (현 정권의 정당성 상실에 대한 근거)Article 2 (Grounds for the Loss of Legitimacy)
북한과도임시정부는 다음 각 호의 사유로 현 북한 정권이 '실패한 국가'를 넘어 통치 자격을 영구히 상실했음을 선언한다.
1. 반인도적 범죄의 국가 정책화: 살인, 고문, 강간 등 반인도적 범죄를 국가 정책으로 채택.
2. 현대판 노예제 운영: 정치범수용소를 통해 주민을 강제 노동과 고문에 처함.
3. 식량권의 고의적 박탈: 정권 유지를 위해 대규모 아사를 방치하거나 유도.
4. 종교 및 사상의 자유 말살: 특정 종교나 신념을 가진 집단을 말살하려는 박해.
5. 이동의 자유 원천 봉쇄: 탈북을 시도하는 주민을 사살하거나 처벌.
6. 법치주의의 부재: 공정한 재판 없는 즉결 처형 자행.
7. 세습 독재와 신정 체제: 공화국 명칭을 도용하여 혈통 세습 독재 유지.
8. 정보의 차단과 우민화: 외부 세계와의 정보 소통 차단.
9. 외국인 납치 및 테러: 국제법 질서 위반.
10. 해외 노동자 착취: 인신매매성 국가 사업 운영.
The Provisional Government declares that the current North Korean regime has lost its qualification to rule for the following reasons:
- State Policy of Crimes Against Humanity
- Operation of Modern-day Slavery
- Deliberate Deprivation of Right to Food
- Eradication of Freedom of Religion and Thought
- Total Blockade of Freedom of Movement
- Absence of Rule of Law
- Hereditary Dictatorship and Theocracy
- Information Blockade and Obscurantism
- Abduction of Foreigners and Terror
- Exploitation of Overseas Workers
제3조 (글로벌 시민 국가의 정의)Article 3 (Global Citizen State)
① 북한과도임시정부가 지향하는 국가는 혈통주의와 배타적 민족주의를 거부하고, 자유, 민주주의, 인권의 가치를 공유하는 전 세계 모든 이들에게 열려 있는 '글로벌 시민 국가'이다.
② 국가는 인종, 피부색, 출신 국가에 관계없이 본 헌법의 가치에 동의하고 국가 건설에 기여하고자 하는 세계 시민을 포용한다.
① The state aimed for by the Provisional Government rejects jus sanguinis and exclusive nationalism, and is a 'Global Citizen State' open to everyone sharing the values of freedom, democracy, and human rights.
② The State embraces global citizens regardless of race, skin color, or country of origin.
제4조 (외국인의 시민권 및 공직 진출)Article 4 (Foreigner Rights)
① 북한과도임시정부 헌법에 동의하고, 독재 정권의 붕괴, 외교적 고립 탈피, 경제 재건 등에 지대한 공헌을 한 외국인은 그 출신, 민족, 국적에 상관없이 본인의 의사에 따라 시민이 될 수 있다.
② 제1항에 따라 시민이 된 자는 장관, 차관, 국회의원, 대법관 등 정부의 주요 공직에 선출되거나 임명될 수 있는 피선거권과 공무 담임권을 내국인과 동등하게 보장받는다.
① Foreigners who agree to the Constitution and have made significant contributions may become citizens regardless of origin.
② Naturalized citizens are guaranteed the right to hold public office, including major government posts, equal to nationals.
제5조 (임시정부의 주체적 역할)Article 5 (Subjective Role)
북한과도임시정부는 단순히 미래를 준비하는 과도기적 관리자가 아니라, 전 인민적인 봉기를 조직하고 지원하며, 독재 정권의 폭력에 맞서 싸우는 능동적인 주체로서의 의무와 책임을 다한다.
The Provisional Government fulfills its duties as an active subject that organizes uprisings and fights against dictatorship, rather than merely being a transitional manager.
